A full trial may be needed to determine whether Gregory Lane is a private road or a public thoroughfare.
Judge John Roach of the 296th District Court in McKinney refused last month to grant summary judgement sought by the city of Parker and Restore the Grasslands (RTG), the developer seeking to build on 101 acres between Parker and Murphy.
Roach held a May 27 hearing on Case No. 296-02421-2024 and issued his order on July 28.
RTG wanted to use Gregory Lane for ingress and egress to the development, which would have only one other access point leading to North Murphy Road/Hogge Road across from Southfork Ranch.
“This is a very small battle in a very big war,” said Stewart Matthews, attorney for Gregory Lane residents.
Communities & Creeks United, a 501(c)(3) nonprofit formed to protest the project, said, “This ruling confirms there are real legal questions that deserve to be fully heard — not dismissed through legal shortcuts. The developer’s effort to gain access through Gregory Lane is not just a threat to the character of the neighborhood; it is an overreach based on faulty claims and weak evidence.”
